Terms & Conditions for Shocking Sale Package

 
  1. These terms and conditions shall be construed and read together with Clause 21 (Paid Advertising) and other terms and conditions set out in Shopee's Terms of Service.

  2. Upon purchasing a Shocking Sale package, you are entitled to nominate product(s) for promotion (“Nominated Product”), depending on the number of slots included in the package purchased and availability, the specified validity period (“Package Service Period”), and campaign date (“Campaign Date”).

  3. All product nominations are subject to Shopee’s approval based on criteria as determined by Shopee from time to time at its absolute discretion.

  4. Once a Nominated Product has gone live, it cannot be retracted or removed and the nomination shall expire at the end of the Campaign Date.

  5. Each Shocking Sale package must be fully utilised within the Package Service Period. Unused slots may not be carried forward, extended, or refunded.

  6. Purchases of Shocking Sale packages are non-cancellable and non-refundable after the payment process is completed.

  7. The Shocking Sale package fee will be charged on top of prevailing transaction, service and commission fees.

  8. Shopee reserves the right to restrict sellers from participating in the Shocking Sale package if any abusive behaviour, suspicious and/or fraudulent activities are detected. The said seller might risk being excluded from all Shopee activities, present or future, at Shopee’s discretion and Shopee shall be entitled to restrict or limit its services and incentives to the seller.

  9. Shopee reserves the right to, at any time, terminate, change, amend, delete or add to these Terms and Conditions and other rules and regulations including the mechanism of the Shocking Sale package at our absolute discretion without prior notice ("Modification"). The seller’s continued participation in the Shocking Sale package after the Modification has been posted shall constitute the seller’s acceptance of such Modification.

  10. This Shocking Sale package terms and conditions shall be governed under the laws of Malaysia. In the event of any dispute, controversy, claim or difference of any kind whatsoever arising between the parties in connection with this programme terms and conditions, including the breach, termination or validity of this programme terms and conditions, or in connection with the determination of any matters which are subject to objective determination pursuant to this Shocking Sale package terms and conditions (“Dispute”), which Dispute has been subject of a written notice by one party to the other (“Dispute Notice”), the parties shall attempt, for a period of thirty (30) days after the receipt by one (1) party of a notice from the other party of the existence of a Dispute, to settle such Dispute in the first instance by mutual discussions between the senior management of each of the parties. If the Dispute cannot be settled by mutual discussions within the thirty (30) day period, it shall be referred to and finally resolved by arbitration administered by the Asian International Arbitration Centre (“AIAC”) in accordance with the Arbitration Rules of the Asian International Arbitration Centre (“AIAC Rules”) for the time being in force, which rules are deemed to be incorporated by reference in this clause. There will be one (1) arbitrator who shall be jointly appointed by the parties. If the parties are unable to agree on the arbitrator, the arbitrator shall be appointed by the Director of the AIAC in accordance with the AIAC Rules. The language of the arbitration shall be English. The place and seat of arbitration shall be Kuala Lumpur, Malaysia.

  11. In the event of any inconsistency between these Terms and Conditions and the Shopee Terms of Service, Shopee’s Terms of Service shall prevail.
