It is Seller’s responsibility to ensure that their proposed item complies with all laws and is allowed to be listed for sale in accordance with Shopee’s terms and policies before listing the item on the selling platform. For the Sellers’ convenience, Shopee has provided below a non-exhaustive guideline on prohibited and restricted items that are not allowed for sale on Shopee. Shopee will update this guideline from time to time where necessary. Please visit this page regularly for updates.
1. VIOLATION OF OUR TERMS OF SERVICE
Violations of this Prohibited and Restricted Items Policy may subject the Seller to a range of adverse actions, including but not limited to any or all of the following:
− Listing deletion
− Limits placed on Account privileges
− Account suspension and termination
− Legal actions
2. LIST OF PROHIBITED AND RESTRICTED ITEMS
(i) Animal and wildlife products (including, without limitation, wild animals);
(ii) Artifacts and antiquities;
(iii) Used cosmetics;
(iv) Counterfeit currency and stamps;
(v) Credit and debit cards;
(vi) Currency or credits including, without limitation, digital currency or credits, and stored value cards;
(vii) Drugs, prescription-only medicines, pharmacy-only medicines, drug-like substances and associated paraphernalia. For more information, please click https://www.pharmacy.gov.my/v2/en/apps/iklan;
(viii) Telecommunication equipment that has not been registered with the Malaysian Communications and Multimedia Commission (MCMC), and electronic surveillance equipment and other similar electronic equipment such as cable TV, de-scramblers, radar scanners, traffic signal control devices, wiretapping devices and telephone bugging devices;
(ix) Embargoed goods;
(x) Firearms, weapons such as pepper spray, stun guns, etc., and imitations of weapons (anything which has the appearance or is intended to give the impression of being an arm, whether it is capable of discharging any shot, bullet, missile, noxious liquid, gas or other thing, or not);
(xi) Alcohol (a valid license must be submitted to, and approved by, Shopee);
(xii) Prohibited Food: For the safety of our Users, Sellers may not list the following food and food-related items on our Site:
a. Listings containing medicinal claims - that is, a claim that the item is intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease in humans and/or animals, contraception, inducing anaesthesia or otherwise preventing or interfering with the normal operation of a physiological function, whether permanently or temporarily, and whether by way of terminating, reducing or postponing, or increasing or accelerating, the operation of that function or in any other way (for example, pharmaceutical drugs, contact lenses, misbranded dietary supplements);
b. Noxious food items - Food which contains any prohibited substances or substances in excess of permitted proportions, adulterated food without fully informing Buyer at the time of sale of the nature of the transaction;
c. Unpasteurised dairy products;
d. Wild mushrooms; and
e. Any other food items hazardous to human health.
(xiii) Food not falling into the Prohibited Food category above must adhere to these minimum standards and guidelines:
a. Expiration dates – all food items must be clearly and properly labelled with an expiration or “use by” date. Expired food items must not be listed.
b. Sealed containers – all food and related products sold on the Site should be packaged or sealed to ensure that Buyer can identify evidence of tampering or defect; and
c. Perishable food items - Sellers who list perishable items should clearly identify in the item description the steps that they will take to ensure that the goods are properly packaged.
(xiv) Royalty or Government related items (imitation or otherwise):
a. Royalty (includes the Yang di-Pertuan Agong or a State ruler), government or enforcement authority related titles, emblems, awards, stickers, badges, official seals, standards, coat-of-arms, or Darjah-darjah Kebesaran, Bintang-bintang & Pingat-pingat Persekutuan such as Dato/Datin, Tan Sri/Pn Sri, etc.;
b. Any official government uniform / government occasion related attire, which include attire with government logos, badges, insignia or accessories, for e.g. Pakaian Rasmi Istiadat bagi Pegawai Tadbir dan Diplomatik / PDRM / RELA / Bomba / Malaysian Armed Forces / JPAM / APM, or any attire related to enforcement authorities;
c. Equipment used for the creation and/or alteration of identification or official documents, or services offering to create and/or alter identification or official documents, or listing identification or official documents for sale including but not limited to visa, passport, national ID card, driving licence, residence permit, work permit, halal related certifications or any government / official certification or document not mentioned above;
d. Any other item that contains logos, badges, emblems, insignia or accessories related to Royalty, government or enforcement authorities not specifically mentioned above.
(xv) Human parts or remains;
(xvi) Lock-picking devices;
(xvii) Lottery tickets;
(xviii) Unregistered / illegal pesticides;
(xix) Potentially infringing items: Items including but not limited to replicas, counterfeit items, and unauthorized copies of a product or item which may be in violation of certain copyrights, trademarks, or other intellectual property rights of third parties;
(xx) Services: Unless expressly allowed by Shopee, the provision of services, including but not limited to services that are sexual, illegal in nature or in violation of the Terms of Service, are prohibited on Shopee’s platform;
(xxi) Slot machines;
(xxii) Recalled items;
(xxiii) Shares, stock, other securities and stamps;
(xxiv) Tobacco or tobacco-related products, including without limitation vapes, electronic cigarettes/e-juices or vape liquids with/without nicotine or containing any other substances, components, tools, devices and accessories related to the consumption of tobacco, tobacco products or vape, and such other materials which may directly or indirectly promote any tobacco product, tobacco brand or smoking generally;
(xxv) Offensive, controversial, seditious or treasonous materials;
(xxvi) Obscene or adult materials:
a. Images displaying explicit depictions of private body parts and pubic hair, either directly or through translucent material;
b. Products exhibiting the contour of genitals through clothing, with the exclusion of men’s underwear;
c. Product images portraying physical contact with private body parts, including instances where hands are depicted within the underwear. However, images related to breastfeeding and breastfeeding tools are permissible;
d. Models, figurines, animals, cartoon characters, etc., depicted in sexual positions or engaging in sexual acts;
e. Sex toys, objects or devices, regardless of whether displaying realistic private parts or human likenesses, used for or to facilitate sexual acts or pleasure but excluding contraceptive devices;
f. Sex dolls, love dolls, blow-up dolls. The use of child-like sex dolls is strictly prohibited. This prohibition extends to products that suggest the doll represents a juvenile, such as “child sex doll”, “14 years old”, and items like children’s clothes, shoes, school backpacks, school uniforms, etc.;
g. Sadism & Masochism (S&M) devices, objects, products and any related material;
h. Pornographic content;
i. Child pornography;
j. Adult video games;
k. Adult services of a sexual/inappropriate nature (e.g. escort services, webcam services, etc.);
l. Any other offensive, graphic, inappropriate or distasteful items not specifically mentioned above.
(xxvii) Products that
a. relate to campaigns, elections, political issues, terrorism or issues of public debate,
b. advocate for or against, or attack a politician or political party,
c. promote or encourage any form of hate, crime, prejudice, rebellion or violence, or
d. are intended to shock, disgust, promote suicide or self-harm.
(xxviii) Publications, books, films, videos and/or video games that do not comply with applicable laws in the country of sale and/or delivery;
(xxix) Stolen goods;
(xxx) Mislabelled goods;
(xxxi) Used undergarments;
(xxxii) Any other items that are, or that contain components that are (i) illegal or restricted in the jurisdiction of the Buyer and/or the Seller or which otherwise encourage illegal or restricted activities, or (ii) determined by any governmental or regulatory authority to pose a potential health or safety risk; and
(xxxiii) Tickets and vouchers (including resale tickets and vouchers, and whether physical or otherwise) for events, concerts or performances of a private or public nature.
If you see a listing that violates our policies, please report it to us by clicking the “Report this Product” or “Report this User” button from the drop-down menu in the product or the user page. When a policy violation occurs, we will send an email, system message and push notification to Seller to let them know that the listing has been removed from our Website. We will also send a push notification to Buyer of said listing. You are responsible for ensuring that your phone settings allow you to receive push notifications.
